香港虚拟资产新政明日生效 散户下半年有望直接购买比特币

据香港证监会消息，《适用于虚拟资产交易平台营运者的指引》将于2023年6月1日生效。香港证监会行政总裁梁凤仪5月30日表示，香港证监会在制定虚拟资产交易平台营运者指引时，将如何保护投资者放在首要考虑位置。

According to the Hong Kong CVM, the Guide for the Operators of the Virtual Asset Trading Platform will come into effect on 1 June 2023. On 30 May, the CVM Executive Director of Hong Kong, Liang Feng Yi, stated that the CVM placed the protection of investors at the top of its agenda when developing guidelines for the operators of the Virtual Asset Trading Platform.

虚拟资产平台需持牌上岗

据悉，《适用于虚拟资产交易平台营运者的指引》订明多项适用于持牌交易平台的标准和规定，包括稳妥保管资产、分隔客户资产、避免利益冲突及网络保安。

It was informed that the Guidelines applicable to the operators of virtual asset trading platforms set out a number of standards and provisions applicable to licensed trading platforms, including safe custody of assets, separation of customer assets, avoidance of conflicts of interest and network security.

根据另一份《咨询总结》，香港证监会为提供非证券型代币交易服务的中心化虚拟资产交易平台设立了全新发牌制度（“VASP”牌照），意味着所有在香港经营业务或向香港投资者积极推广其服务的虚拟资产交易平台，不论是否有提供证券型代币交易服务，均需获香港证监会发牌并受其监管，无意申领牌照的营运者，香港证监会则要求以有序方式结束其于香港的业务。新政意味着香港对加密货币交易平台提供了合规的监管路径，虚拟货币交易的香港模式呼之欲出。

According to another advisory summary, the Hong Kong CSRC has set up a completely new licensing system (“VASP”) for the central virtual asset trading platform that provides non-synchronous currency exchange services. This means that all virtual asset trading platforms operating in Hong Kong or actively promoting their services to Hong Kong investors are licensed and regulated by the CSRC, whether or not they provide a securities trading service, and that operators who do not wish to obtain a licence are required to end their operations in Hong Kong in an orderly manner.

对于散户直接交易虚拟货币的问题，香港证监会强调，目前尚未批准任何虚拟资产交易平台向零售投资者提供服务，且现有大部分公众可接触的虚拟资产交易平台均不受香港证监会监管。

With regard to the issue of bulk direct transactions of virtual currencies, the CVM stressed that no virtual asset trading platform had been approved to provide services to retail investors and that most of the existing virtual asset trading platforms accessible to the public were not regulated by the CVM.

不过，此前香港证监会曾称回应者对容许持牌虚拟资产交易平台向零售投资者提供服务表示大力支持。证监会将落实有关容许持牌虚拟资产交易平台向零售投资者提供服务的建议。并强调平台运营者在为零售投资者提供服务之前，应当进行相应的知识及风险评估和投资者培训，并制定风险承担限额。这意味着散户投资者有望直接通过交易所购买比特币等主流加密货币。

Previously, however, the Hong Kong CVM had stated that there was strong support among respondents for allowing licensed virtual asset trading platforms to provide services to retail investors. The CVM would implement the recommendation to allow licensed virtual asset trading platforms to provide services to retail investors.

香港证监会中介机构部临时主管蔡钟辉日前在接受媒体采访时表示，暂时未有平台可给予散户投资者买卖虚拟资产，预料在指引生效后，散户最快在今年下半年可于获发牌的交易平台进行买卖。

In an interview with the media, the Interim Head of the Securities Commission Intermediary Department of Hong Kong stated that there was no platform to buy and sell virtual assets to bulk investors and that it was expected that, following the entry into force of the guidelines, the clearing house would be able to do so as soon as possible in the second half of this year on a licensed trading platform.

香港加密货币交易的标准：稳定币暂被排除在外

为了被允许进行散户交易，加密货币代币必须满足 香港证监会的严格规定。首先，代币必须具有至少 12 个月的监管合规性。在此期间，这些代币所属的项目不应受到任何刑事指控。另一方面，这些代币必须至少在两个主要独立投资公司的可投资指数上。不符合这些要求的代币将无法符合交易资格。据不完全统计，目前符合标准的代币包括：比特币、以太坊、莱特币、Polkadot、比特币现金、Polygon 等。值得注意的是，香港证监会目前没有计划允许稳定币交易。

In order to be allowed to conduct bulk transactions, the encrypted currency tokens must meet the strict requirements of the Hong Kong CSRC. First, the tokens must have at least 12 months of regulatory compliance. During this period, the items to which they belong should not be subject to any criminal charge. On the other hand, they must be at least on the investmentable index of the two main independent investment companies.

2022年10月31日，香港特区政府在香港金融科技周上正式发表《有关虚拟资产在港发展的政策宣言》，阐明港区政府为在香港发展具活力的虚拟资产行业和生态系统而制定的政策立场和方针。在此之前，港区政府曾表明要成为全球虚拟资产中心。

On 31 October 2022, the Hong Kong Government officially issued a Policy Declaration on Virtual Assets Development in Hong Kong during the Hong Kong Financial Science and Technology Week, setting out the policy position and approach of the Hong Kong Government to develop a vibrant virtual asset industry and ecosystem in Hong Kong.

在今年4月举行的香港Web3嘉年华开幕式上，香港财政司司长陈茂波表示，现在是Web3发展的黄金机遇，同时也是最惊心动魄的时刻。Web3正处起始期，目前常见的应用包括加密货币、去中心化交易所、区块链游戏，但未来将会有更多新的应用和机遇。

At the opening ceremony of Hong Kong’s Web3 Carnival in April this year, Hong Kong’s Director of Finance, Chen Maobo, said that it was the golden opportunity for Web3 development, and that it was also the most exciting time. Web3 was at the start, and its most common applications now included encrypted currency, decentralized exchange, block chain games, but there would be more new applications and opportunities in the future.
